Habitat v. City of Santa Cruz

Lawyers dealing with environmental law fight through cases all the time involving water and sewer services.  This is just one of the many examples of the types of cases that take place.

In a recent case, Habitat & Watershed Caretakers v. City of Santa Cruz, Habitat challeneged the city's certification of a final environmental impact report for a project to permit the city to provide extraterritorial water and sewer services to the proposed new developement.

The City of Santa Cruz did not prevail and Habitat & Watershed Caretakers did, meaning the project would not go through.

Should the state or federal government be in charge of a state's water rights?

The watershed, is where the water drains to in the city.
